December seems to be one of the busiest times of the year for many Alaskans, as well as the law firm. Avoid legal problems by keeping in mind the following:

If you married, divorced, or purchased stocks in 1998, consult with your CPA or accountant about tax consequences.

If there are holiday visitation issues, attempt to work out an agreement far in advance with the other parent, and if that fails, file early to avoid the last minute emergency rush. See last month's newsletter for more details.

Wear seat belts and designate drivers if drinking to minimize the risk of injuries, accidents and arrests this holiday season.

BEFORE YOU GIVE ANY STATEMENTS TO THE POLICE:

know your rights

 

You have the right to remain silent

Anything you say can and will be used against you in a court of law

You have the right to talk to a lawyer and can have him present with you while you are being questioned

If you cannot afford to hire a lawyer, one will be appointed to represent you before any questioning if you wish

If you decide to answer questions without a lawyer present, you still have the right to stop answering at any time

IF YOU ARE IN AN AUTO ACCIDENT:

Stop. Leaving the scene of an accident is a crime

Check to see if anyone is hurt

Call the police and an ambulance, if necessary

Exchange information with the other driver, including names, addresses, phone numbers, license numbers, insurance carriers and policy numbers

Obtain names, addresses and phone numbers of witnesses

If you have a camera, take pictures of the accident scene

Consider talking with your lawyer before you make any statements to anyone about the accident to learn your rights and to make informed decisions

If you may be injured, go to the emergency room as soon as possible

Report the accident to your insurance company
